Terms & Agreements Selecteddisco V.O.F.
GENERAL TERMS AND CONDITIONS FOR EVENT VISITORS
Article 1 – AGREEMENT OVERVIEW
These General Terms and Conditions ("GTC") apply between Selecteddisco V.O.F., located at Hoekstraat 6e, 9712 AN, Groningen (the “Organiser”), and any person purchasing or using an event admission ticket (“Admission Ticket”). When a person purchases an Admission Ticket and attends an event hosted by the Organiser (“Event”), an agreement arises between the Organiser and the ticket holder or attendee (“Visitor”), with these GTC as its basis.
Article 2 – ADMISSION TICKET
Admission Tickets are available exclusively through the Organiser’s official website and authorized third-party sellers, whose identities are disclosed on the Event website. Tickets are restricted to consumers aged 18 and above, with an upper purchase limit per Buyer, as determined by the Organiser. Tickets are non-refundable once purchased, and the Organiser reserves the right to decline ticket orders.
Each Admission Ticket, issued as a physical ticket or a barcode, grants one-time access to a single individual. It will be delivered via email or app and must be shown at the Event entrance. Once an Admission Ticket is received, the Visitor assumes all responsibility for any risk of loss, theft, damage, or misuse. Only tickets from authorized sellers guarantee validity, and the Organiser reserves the right to deny access if ticket tampering or fraudulent resale is suspected.
Article 3 – RESALE PROHIBITION
Admission Tickets are for personal use only and cannot be resold for commercial purposes. The Buyer may only sell tickets to others at face value. Any violation may result in ticket cancellation, denied entry, and potential penalties. The Organiser may impose an immediate fine of EUR 5,000 per infraction and EUR 1,000 for each day the infraction continues. Should a Buyer or Visitor violate these conditions, the Organiser is entitled to deny access to the Event and invalidate the Admission Ticket without issuing any form of refund.
Article 4 – EVENT ENTRY REQUIREMENTS
By attending the Event, each Visitor agrees to these GTC. The Event premises include all related grounds and facilities. Only Visitors aged 18 or older with valid identification will be admitted, and every Visitor must carry an undamaged Admission Ticket throughout the Event. If a ticket is damaged or suspected of forgery, entry may be denied without any refund.
Visitors must consent to security searches before entry; refusal may result in denied access without a refund. Items such as professional audio-visual equipment, glassware, fireworks, dangerous objects, drugs, laughing gas, and alcohol are strictly prohibited on Event premises, and confiscated items will not be returned. Visitors bringing these items may face ejection and/or police involvement without entitlement to a refund.
Article 5 – EVENT PARTICIPATION AND RECORDING
Visitors may not record the Event through photos, video, or audio without prior approval from the Organiser. Security cameras may be operational for supervision and safety. Re-entry is not permitted if a Visitor leaves the Event premises once inside.
All Visitors must adhere to instructions from Event staff, security, and other authorized personnel. Only tokens or credit purchased at the Event will be valid for on-site purchases, and they expire at Event close with no obligation for post-Event refunds. The Organiser may also offer locker rentals subject to separate conditions, and Visitors are encouraged to keep their access codes secure, as the Organiser is not responsible for loss or theft of items stored in lockers.
Without prior written consent from the Organiser, the distribution or sale of goods, promotional activities, and unauthorized postings are prohibited in or around the Event venue. Any violation of public order regulations (such as public intoxication or aggressive behavior) or House Rules will result in removal without refund. The Organiser’s decisions on unspecified situations will be final.
Article 6 – ORGANISER’S RIGHTS
The Organiser reserves the right to cancel any Admission Ticket or deny entry if the Visitor breaches these GTC, without issuing any form of refund. Visitors may also be removed to maintain Event order.
Selecteddisco provides specific programming for each Event, as outlined on its website, and will make reasonable efforts to follow the planned schedule. However, programming details, artist line-ups, and start times are subject to change, and these adjustments do not entitle Visitors to compensation. Additionally, the Organiser may make recordings for promotional use, and all intellectual property rights are reserved.
Article 7 – FORCE MAJEURE
If an Event is canceled or rescheduled due to circumstances outside the Organiser’s control (e.g., artist illness, government restrictions, extreme weather), this will be considered force majeure. In such cases, the Organiser may postpone the Event, relocate it, or cancel entirely. Tickets may remain valid for rescheduled events held within 13 months of the original date. If the Visitor is unable to attend the rescheduled Event, they may request a voucher equivalent to the ticket price, usable at future Events. Refund requests will be processed within three months after the rescheduled date.
The Organiser will not be held liable for any travel or accommodation expenses related to cancellations or postponements. Partial Event cancellations do not entitle Visitors to refunds, but the Organiser may offer a discount on future Events in such cases.
Article 8 – LIMITATION OF LIABILITY
The Organiser will only be held liable for direct damages that result from an attributable breach and are covered by its insurance. The following damages are excluded:
a) Indirect or consequential losses;
b) Non-material damages;
c) Damages due to third-party misconduct.
Claims for damages must be submitted within seven days of the incident, accompanied by the original ticket and proof of payment. Visitors attend the Event at their own risk, and the Organiser disclaims liability for personal injury, hearing impairment, or other injuries. Additionally, the Organiser is not responsible for lost, stolen, or damaged personal property.
Article 9 – DATA PRIVACY
The Organiser processes Visitor personal data under the GDPR and acts as the data controller. Detailed information on data processing can be found in the Privacy Statement on the Organiser’s website.
These GTC are subject to periodic updates. Should any provision become void or unenforceable, the remaining provisions remain valid. Any ambiguity or unaddressed situation will be resolved in the GTC’s intended spirit.
APPLICABLE LAW AND DISPUTES
All legal relationships involving the Organiser are governed solely by Dutch law, regardless of the Visitor’s location.
